Iraq resort shelling a ‘shocking disregard for civilian life’, UN envoy says

26 July 2022

The deadly shelling of a mountain resort in northern Iraq last week represented a shocking disregard for civilian life and international obligations on civilian protection, the UN Special Representative for the country, Jeanine Hennis-Plasschaert, told the Security Council on Tuesday.

Ambassadors convened late in the afternoon New York time, to discuss the 20 July attack in Zahko, a city in the Kurdistan region near the border with Türkiye, in an area where Turkish forces are conducting counter-terrorism operations against outlawed militant groups.

Ms. Hennis-Plasschaert provided a timeline of developments since five artillery rounds struck the Parkha resort, which was packed with visitors, including children. Nine people were killed and 33 injured.

Precautions disregarded

Iraq attributed the attack to Turkish forces, but Ankara issued a press release stating that it is “against all kinds of attacks targeting civilians” and “ready to take all steps to reveal the truth”, she reported.

“This horrific attack on a well-known and clearly identifiable tourist site demonstrates a shocking disregard for civilian life and for the universally accepted standards of international humanitarian and human rights law which seek to protect civilians,” said Ms. Hennis-Plasschaert.

“While all parties to any conflict must take all feasible precautions to avoid harm to civilians at all times, this was clearly not adhered to.”

The UN envoy said she spoke with Iraq’s Prime Minister on Monday, who again emphasized the importance of conducting a transparent and thorough investigation into the incident, whether independently, or jointly.

“It is vital, he said, to put a stop to speculations, denials, misunderstandings and rising tensions,” she told ambassadors. “Meanwhile, I understand that Türkiye is also ready to address the issue jointly, with Iraq, in order to determine exactly what happened.”

Attacks must cease

Ms. Hennis-Plasschaert stressed that it is of the greatest importance that all attacks on Iraqi territory cease.

“Such aggression not only recklessly heightens national and regional tensions but also causes, as we have seen, grave human tragedies,” she said.

“As I have said many times in past years, Iraq rightfully rejects the notion that it can be treated as an arena for external and regional rivalries - as an arena where neighbours, and any other actor for that matter, routinely, and with impunity, violate its sovereignty and territorial integrity.”

Myanmar junta's execution of four democracy activists condemned by UN

25 July 2022

The independent UN human rights expert for Myanmar called for a strong international response on Monday following the executions of four pro-democracy activists by the country’s military junta. In a statement issued later in the day, UN human rights chief Michelle Bachelet said she was "dismayed" that despite appeal from across the world, military leaders had move ahead with "no regard" for international rights law.

Thomas Andrews said he was “outraged and devastated” following what’s believed to be the first use of capital punishment in the Southeast Asian nation in decades.

The four - including activist Ko Jimmy and lawmaker Phyo Zeya Thaw - were convicted of helping to carry out alleged "terror acts".

“This cruel and regressive step is an extension of the military’s ongoing repressive campaign against its own people", said High Commissioner Bachelet.

“These executions – the first in Myanmar in decades - are cruel violations of the rights to life, liberty and security of a person, and fair trial guarantees. For the military to widen its killing will only deepen its entanglement in the crisis it has itself created.”

Ms. Bachelet called for the immediate release of all political prisoners and others arbitrarily detained, and urged the country to reinstate its de-facto moratorium on the use of the death penalty.

Sentenced to death in closed-door trials in January and April, the four men had been accused of helping insurgents to fight the army that seized power in a coup on February 1 last year, and unleashed a bloody crackdown which has resulted in multiple rights abuses.

Violations of international law

The executions were carried out despite worldwide pleas for clemency for the four men, including from UN experts and Cambodia, which holds the rotating chairmanship of the Association of Southeast Asian Nations (ASEAN).

Mr Andrews condemned the decision to go ahead with the executions when they were announced in June. In a statement he said the men were “tried, convicted and sentenced…without the right of appeal and reportedly without legal counsel, in violation of international human rights law.”

He called for “strong action” from UN Member States against the “widespread and systematic murders of protesters, indiscriminate attacks against entire villages and now the execution of opposition leaders.”

“The status quo of international inaction must be firmly rejected,” he added.

In June, UN Secretary-General António Guterres also called for charges to be dropped "against those arrested on charges related to the exercise of their fundamental freedoms and rights, and for the immediate release of all political prisoners in Myanmar".

UN Special Rapporteurs such are tasked with specific thematic or country mandates by the Geneva-based Human Rights Council, where they report back on their fact-finding or monitoring missions, usually at one of the forum’s three regular sessions a year. The expert positions within the Council’s Special Procedures section are honorary and incumbents are not paid for their work.

Prominent activists

Among those executed was Phyo Zeya Thaw, a former lawmaker from ousted leader Aung San Suu Kyi’s National League for Democracy party. Also known as Maung Kyaw, he was convicted in January by a closed military court of offences involving possession of explosives, bombings and financing terrorism.

Phyo Zeya Thaw was arrested last November based on information from people detained for shooting security personnel, state media said at the time. He was also accused of being a key figure in a network that carried out what the military described as terrorist attacks in Yangon, the country’s biggest city.

Also executed was democracy activist Kyaw Min Yu, better known as Ko Jimmy, for violating the counterterrorism law. He was one of the leaders of the 88 Generation Students Group, veterans of a failed 1988 popular uprising against military rule.

He already had spent more than a dozen years behind bars for political activism before his arrest in Yangon last October. He had been put on a wanted list for social media postings that allegedly incited unrest, and state media said he was accused of terrorist acts including mine attacks and of heading a group called Moon Light Operation to carry out urban guerrilla attacks.

The other two, Hla Myo Aung and Aung Thura Zaw, were convicted of torturing and killing a woman in March 2021 who they allegedly believed was a military informer.

First execution since 1976

The last judicial execution to be carried out in Myanmar is generally believed to have been of another pro-democracy activist, student leader Salai Tin Maung Oo, in 1976 under a previous military government led by dictator Ne Win.

In 2014, during the period of democratic reform, the sentences of prisoners on death row were commuted to life imprisonment, but several dozen convicts received death sentences between then and last year’s takeover.

Libya: Human rights abuses, political stalemates, electoral delays mar progress

25 July 2022

The overall situation in Libya remains “highly volatile”, Martha Pobee, UN Assistant Secretary-General for political affairs and peace operations, told the Security Council on Monday.

Despite some progress, a constitutional and political stalemate continues, prolonging tensions and fuelling insecurity, while clashes in and around Tripoli surge, she added.

“The economic situation remains dire,” she continued. “We have witnessed demonstrations by frustrated Libyans over the lack of progress on elections and poor State services. In addition, the human rights situation in the country remains of “serious concern”.

Leaders must ‘heed the call’

While promising progress has been achieved on the constitutional track, consensus on the eligibility requirements for a presidential candidate remains elusive.

Earlier this month, demonstrators across Libya expressed their frustration over political divisions and deteriorating living conditions.

They demanded that elections be held soon, and solutions to the country’s electricity crisis and fuel shortage. Some stormed and damaged the Parliament building in Tobruk, the centre of power for the eastern faction vying to control the country.

“We urge Libya’s political actors to heed the call of their people, and to demonstrate responsible leadership by addressing their grievances,” said the senior UN official.

Divisions provoke violence

As armed groups rally behind their leaders, military activity has increased in the western region – power base of the internationally-recognized Government based in the capital - including on the eastern flank of Tripoli, Misrata and in the outskirts of Sirte.

“We are deeply concerned about the armed clashes in Tripoli that took place on the night of 21 July and the skirmishes in Misrata on 23 July, between armed groups resulting in an unconfirmed number of civilian casualties,” she stated, calling for the ceasefire to be maintained.

Oil production

At the same time, Ms. Pobee expressed concern over the ongoing disagreement regarding the leadership of the National Oil Corporation (NOC).

Since 16 April, a shutdown had reduced Libyan oil exports by two thirds and cost the country $4 billion in lost revenue.

On 12 July, the UN and internationally backed interim premier, Abdulhamid al-Dbeibah, appointed the former Libyan Central Bank governor as new NOC chairperson, with oil exports resuming on 19 July.

Although it is too soon to confirm whether oil production will return to full capacity and how it will impact oil production and exports going forward, Ms. Pobee underlined the need for the Corporation to “remain neutral and free from the pressure of political interests”.

Threat to basic human rights

Meanwhile, the economic situation has impacted people’s fundamental rights to basic services and access to food, water and sanitation, healthcare, and education.

Moreover, the UN Support Mission in Libya (UNSMIL) has received reports that medical facilities lacked surgical supplies and faced severe challenges from extended power cuts and lack of generator fuel; protestors have been arbitrarily arrested by armed groups; and serious allegations of torture have been made against Libyans, migrants, and asylum-seekers in detention facilities and prisons.

“Of most concern, a radio station in Zawiya broadcasted hate speech against migrants, asserting they were responsible for spreading diseases,” warned the Assistant Secretary-General.

“Libyan authorities must investigate all allegations of torture and other human rights violations…[and] those responsible must be held accountable”.

Voices of youth

While the UN prioritizes a return to the electoral process, Ms. Pobee underscored the need to keep supporting, and encouraging Libyan counterparts to focus on effectively addressing the key drivers of the political and economic stalemate.

Young Libyans want their leadership to improve living conditions and for elections to be held as soon as possible so they may choose their legitimate representative, according to the UN political affairs official.

“We count on the members of this Council and the wider international community to continue supporting the United Nations in its efforts to facilitate a mutually agreeable solution which will put an end to the continuing crisis,” she concluded.
